These are the rules that you need to follow when using SW19 Pilates. They are here to help you get the most out of our services. Please take a moment to read them. If you don’t agree with any part of these rules, please don’t use our website or services.

1. Interpretation and variation:

This website is owned and run by SW19 Pilates, which is operated by Lisa Newsom Davis. Registered address for SW19 Pilates is 202 Somerset Road, Wimbledon, SW19 5JE.

These rules cover the use of this website as well as the services provided by SW19 Pilates on the website and at our physical location. Please read these rules carefully.

By using this website, purchasing any products or services, or attending a class, you agree to follow these rules.

2. Our contract with you:

These rules explain how we provide our services to you.

Please read these rules carefully and make sure that the information you provide is accurate before making a purchase.

Once you book your first class or sessions, a contract is formed between you and us, and you become a customer of SW19 Pilates.

3. HEALTH AND ABILITY TO EXERCISE

3.1 Before deciding if you can join a class or an online workout plan, you should familiarise yourself with the type of movements involved. If you have any doubts about your fitness level, you should talk to a SW19 Pilates representative for more information. It is your responsibility to prioritise your health, so it is advisable to get approval from your own doctor before participating in any exercise class, whether in person or online.

3.2 We are not medical professionals, and we are not qualified to assess whether you are physically fit or able to exercise without causing harm to your health, safety, comfort, or physical condition.

3.3 It is strongly advised that you seek medical advice before engaging in any physical activities. If you have any concerns about your physical condition, you must get medical approval before starting any exercise. We have the right to refuse access to any customer if we believe, at our discretion, that participating in an online class could endanger their health.

3.4 By purchasing classes or attending SW19Pilates classes, participating in online classes or personal training sessions, you are acknowledging and accepting that there are inherent risks and dangers associated with the intense physical nature of our programs. You have voluntarily chosen to engage in intense physical exercise, and it is highly recommended by SW19Pilates that you consult with your doctor before starting any class, online workout plan, or personal training session.

4. PURCHASING SW19 Pilates GROUP CLASSES AND CLASS BUNDLES

4.1 You have two options for purchasing classes: you can buy them individually, one at a time, or you can choose to buy a bundle of classes.

4.2 When you buy a bundle of classes, it is only valid for a certain period of time from the date of purchase. You can see the expiration date in our online booking system. If you don’t use all the credits before the expiration date, they will be deleted from your account and you won’t get a refund for unused classes.

4.3 You can only join a class if you have signed up for it using our online booking system.

4.4 Unless stated otherwise in these Terms and Conditions, all payments for classes are non-refundable, non-exchangeable, and non-transferable, except for any cancellations you are entitled to under the law.

4.5 The class bundles cannot be transferred to someone else.

4.6 To book a class, you must have purchased a class or class bundle from SW19Pilates and filled out a health questionnaire before attending your first class.

4.7 You can change your booking online and reschedule without any charge up to 24 hours before the start of the class.

4.8 If you need to cancel a booking, you must do it through our online booking system at least 24 hours before the start of the class. If you don’t do this, you will be considered a “late cancel” or a no-show, and the price of the class will still be deducted from your account.

4.9 If you need to cancel a full term of classes, we offer full refunds minus a £4 processing fee if the cancellation is made at least 14 days before the start date. After that, no refund will be given, but you can transfer the tickets to another person.

4.9 If you miss a class, you can make it up by requesting a video from SW19Pilates. You can make bookings for missed classes by calling 07855 822902 or emailing lisa@sw19pilates.com. You must make up missed classes before the end of the block of classes, and you cannot carry them over to the next block booking.

5. SW19 Pilates ONE-TO-ONE SESSIONS

5.1 You need to pay for your One-to-One session before the session starts.

5.2 You can pay for your session online using the Acuity appointment booking system.

5.3 If you need to cancel your booking, please do so at least 24 hours before the class starts. If you fail to cancel within this time, you will be considered a “late cancel” or a no-show, and the cost of the class will be taken from the payment you made.

6. PURCHASING SW19 Pilates KIT ITEMS

6.1 You need to pay for your chosen kit items via the shop link, before I will order them

6.2 When the goods are received by me, I will deliver them to you in person before a class

6.3 You legally have 14 days to return the items for a refund if they are faulty, or you have otherwise changed your mind

7. PRICE AND PAYMENT

The cost of our services, including classes, consultations, and appointments, will be listed on our website and may change over time. However, if there is a clear and obvious mistake in the pricing that you could have reasonably noticed, we are not obligated to provide the items to you at a lower incorrect price.

8. OUR LIABILITY TO YOU

If we do not follow these Terms, we are responsible for any harm or damage you experience that is a result we could have reasonably foreseen from our failure to comply or from our negligence. However, we are not responsible for any harm or damage that is not reasonably foreseeable. Harm or damage is reasonably foreseeable if it is an obvious consequence of our failure to comply or if we and you discussed it at the time we entered into this agreement. We are fully liable for:(a) any harm or injury resulting in death or personal injury caused by our negligence or the negligence of our employees, agents, or subcontractors;(b) any fraud or false representation;(c) any violation of the implied terms stated in section 2 of the Supply of Goods and Services Act 1982 (ownership and peaceful use);(e) any defective products according to the Consumer Protection Act 1987.

9. YOUR RESPONSIBILITY

Make sure you always follow the instructions from SW19 Pilates on how to move correctly or use the equipment. If you’re not sure how to do an exercise or use the equipment properly, ask Lisa Newsom Davis for help. Take care of your health and don’t push yourself too hard during workouts. If you think you have a medical condition that could affect your ability to exercise safely, talk to a doctor and follow their advice before using our facilities. It’s your job to agree to the terms and conditions set by SW19 Pilates.

10. YOUR STATUS

When you make an order on the SW19 Pilates website, you confirm that:(a) you can legally make agreements; and(b) you are at least 18 years old.

11. GENERAL

10.1 The details of our class schedules and times may change occasionally, and we will publish the updated information on our website. We have the right to change or cancel appointments as we see fit, and we will do our best to give you notice of any changes in a timely manner.

10.2 If your address or email changes, please let us know in writing and update these details in your booking account.

10.3 We may contact you by email. By providing us with your email address, you agree to receive email communications from us, including important notices related to these Terms and Conditions. Please be aware that email communication may not be secure and confidential. We cannot be held responsible for any loss or damage caused by communicating with you via email.

12. FORCE MAJEURE

We will not be held responsible or considered in violation of these terms if we are unable to fulfill our obligations due to factors beyond our control. These factors may include natural disasters (like earthquakes, hurricanes, or floods), war or conflicts, government interventions or restrictions, labor disputes, technological issues, or shortages in resources necessary for our operations.

13. OUR ABILITY TO CHANGE THESE TERMS AND CONDITIONS

We can update and modify these Terms and Conditions occasionally to account for shifts in market conditions that affect our business, advancements in technology, changes in payment methods, alterations in laws and regulations, and improvements to our system’s capabilities.
